User responsibility

The user shall be entirely responsible for accessing and correctly using the website in accordance with current legislation, as well as with the principles of good faith, morality, good customs and public order, and with the commitment to duly comply with any additional instructions that, in relation to said use and access, may be given by the translation company Traduspanish. And, in particular, without the following list being exhaustive in nature, it is strictly forbidden for the user, and therefore the consequences thereof shall be the sole responsibility of the user, to do the following:

  • Distribute any part of the site www.traduspanish.com
  • Alter or modify any part of the www.traduspanish.com site by circumventing, bypassing, disabling or otherwise tampering with the functions of the website.
  • Use the website to send spam, advertising or commercial communications, to send messages for advertising purposes or to collect data for the same purpose.
  • Writing false or defamatory comments, trading comments with other businesses or compensating or being compensated for writing or deleting a comment.

Jurisdiction

In the event of any controversy, dispute or claim arising from this document between any Customer/User and the translation company Traduspanish, the parties shall submit to the Courts and Tribunals of Seville, expressly waiving any other jurisdiction to which they may be entitled.

This agreement is accepted by the parties on the date indicated in the accompanying quotation, or on the date of use of the website by the user.

TERMS AND CONTIDIONS

This document constitutes the General Terms and Conditions for the contracting of any of the services provided by the translation company Traduspanish, for which the parties mutually recognise the necessary legal capacity. Acceptance by the client of the quotation or the mere use or visit by the user of the Traduspanish translation company’s website constitutes full acceptance and acceptance of these General Terms and Conditions, without the need for an express signature.

Contracting parties

On the one hand, Adrián Sánchez Alcón, (hereinafter referred to as Traduspanish translation company). And on the other hand, the natural or legal person identified in the quotation or who uses or visits the website belonging to the translation company Traduspanish and located at www.traduspanish.com and www.traduspanish.es (hereinafter, “the Client” or, indistinctly, “the User”).

Stipulations

Object

The purpose of this contract is the provision of any of the following services (hereinafter referred to as “the Services”) by the translation company Traduspanish:

  • Translation of documents, linguistic revision and/or proofreading, content writing and editing, website translation, transcription, etc.
  • Language consultancy and advisory services.
  • Any other ancillary, complementary or related benefits.

 

Form of service provision

Traduspanish Translation Company shall provide the Services in accordance with the following stipulations, and in compliance with the regulations in force:

Capacity to contract. In order to contract the Services, the Client must have legal capacity and the capacity to act, as well as comply with all the requirements established by the law of the country of which he/she is a national. If the Client acts on behalf of a company or legal entity, acceptance of these General Conditions shall imply that he/she has the appropriate powers of representation.

Quotation. In order to purchase the Services, the Client shall contact the Traduspanish translation company. After reviewing the project, Traduspanish Translation Company will provide the Customer with a quotation for approval, subject to the following stipulations:

  • The budget shall establish a time limit for implementation depending on the type of project, which shall start to run from the day following the adoption of the budget, unless the management is carried out urgently.
  • The quotation shall indicate the method of delivery of the service. In the event that the Customer opts for the courier service, the costs shall be borne by the Customer.
  • The quote issued by the Traduspanish translation company shall be valid for 15 calendar days, unless otherwise indicated. After this period of time has elapsed without receiving the Client’s acceptance, Traduspanish Translation Company reserves the right to modify the estimate.

Prices. The prices of the Services shall be fixed according to the specifications of each project.

Modification. The translation company Traduspanish reserves the right to modify at any time, unilaterally and without prior notice, the prices of the Services, as well as its contracting conditions, without such modification being retroactive in any case (i.e. the modification shall not affect the quotations already submitted).

Invoice. If the Client wishes Traduspanish Translation Company to send him/her the invoice for the Service by ordinary mail, he/she must expressly request this by e-mail. The cost of postage shall be borne by the Customer. In the event that this is not indicated, the invoice will be sent to the Customer by e-mail.

Method of payment. The Client shall pay the invoice by bank deposit or bank transfer to the account indicated for this purpose in the quotation and in the invoice issued by the translation company Traduspanish, in the manner and by the deadline indicated therein. All costs arising from payment and collection operations shall be borne exclusively by the Client. Payment by Bizum is also accepted. Occasionally, payment by PayPal may be accepted.

Cancellations by the Client

After contracting Translation Services, the Customer may cancel and withdraw from such contract at any time, remunerating Traduspanish Translation Company for the services rendered on the basis of the work actually carried out up to that time and the inconvenience caused to the parties involved in the project. Where applicable, the Traduspanish translation company shall reimburse the Customer the amount paid for the Service contracted, after deduction of its fee in accordance with the above, as soon as possible.

Confidentiality

The Client, the Traduspanish translation company and its collaborators are obliged to maintain the strictest confidentiality with regard to the information contained in or relating to the commissioned project. However, the Customer authorises Traduspanish Translation Company to publish on its website and in other advertising or marketing materials a reference to the Customer as a member of Traduspanish Translation Company’s client portfolio.

Intellectual property rights

The domain, site and contents of the Traduspanish translation company’s website are the exclusive property of Adrián Sánchez Alcón. The intellectual property rights over the website extend not only to its content and title, but also to its logo, design, images, textures, graphics and any other content, as well as the code with which it is programmed, all of which are protected in accordance with the Consolidated Text of the Intellectual Property Law approved by Royal Legislative Decree 1/1.996, of 2 April, and other Spanish and international legislation in force relating to copyright. The translation company Traduspanish reserves the rights of reproduction, modification, adaptation, public communication, maintenance, correction of errors, transfer, sale, rental, loan and any other intellectual or industrial property right that may correspond to it over the contents of the website of the translation company Traduspanish, and the exercise of the foregoing rights is prohibited without the express authorisation of the owner. Any exercise of the aforementioned rights, regardless of the means or form in which they are produced, requires prior express authorisation from the Traduspanish translation company.

Industrial property rights

The Traduspanish translation company is the owner of the industrial property rights arising from the use of trademarks, distinctive signs and trade names appearing on any of the pages of the Traduspanish translation company’s website, unless expressly provided otherwise.

Security and data protection

Consent. By filling in forms on the Traduspanish translation company’s websites or by sending e-mails or other communications to the Traduspanish translation company’s addresses, the Customer/User expressly consents to the inclusion of his/her personal data in an automated file.

Security of information. The translation company Traduspanish has employed all the systems and technical measures at its disposal to prevent the loss, misuse, alteration, unauthorised access and theft of the data provided by the user. However, the user must be aware that security measures on the Internet are not impregnable.

Transfer of personal information to third parties. The translation company Traduspanish does not sell, transfer or in any way transmit personal information about its Users or Clients to third parties, and translators are not considered third parties for these purposes.

Jurisdiction

In the event of any controversy, dispute or claim arising from this document between any Customer/User and the translation company Traduspanish, the parties shall submit to the Courts and Tribunals of Seville, expressly waiving any other jurisdiction to which they may be entitled.

This agreement is accepted by the parties on the date indicated in the accompanying quotation, or on the date of use of the website by the user.
